(d) (1) Paragraph (2) of subsection (b) shall not apply to any violation of subsection (a) if all the following apply: (A) The taxpayer, the principal obliged, or the co-contractor is a governmental entity. (B) On the date of the violation, neither a civil monetary penalty nor any civil remedies are available in any court against the taxpayer, the principal obliged, or the co-contractor with respect to such violation. (2) Paragraph (1) shall not apply to any civil monetary penalty or any civil remedies that may be available to the taxpayer with respect to such violation.
